Türkiye Cumhuriyeti Hazine ve Maliye Bakanlığı Mali Suçları Araştırma Kurulu Başkanlığı (MASAK) ile Vatikan Şehir Devleti Denetim ve Finansal Bilgi Otoritesi (ASIF), bundan sonra “Mali İstihbarat Birimleri (MİB'ler)” olarak anılacaktır, işbirliği ve karşılıklı menfaat anlayışı içinde, Ülkelerindeki yetkili makamlar tarafından soruşturma ve kovuşturma başlatılması ile sonuçlanabilecek bilgi paylaşımı amacıyla şüpheli karapara aklama, bağlantılı öncül suçlar ve terörizmin finansmanı hakkındaki analizlerin kolaylaştırılmasını istemektedir. Bu amaçla MİB*ler, ilgili Egmont Grubu belgelerini, özellikle “Şartı”nı ve “Mali İstihbarat Birimleri Arasında Bilgi Paylaşım Prensipleri”ni göz önünde bulundurarak ve her birinin ulusal mevzuatı çerçevesinde aşağıdaki şekilde anlaşmaya varmışlardır. Amaç 1. MİB/ler; Şüphelenilen karapara aklama, bağlantılı öncül suçlar ve terörizmin finansmanına ilişkin bilgilerin toplanması, geliştirilmesi ve analizinde Ülkelerinin ulusal mevzuatlarına uygun olarak işbirliği yapacaklardır. 2. MİB”ler, mütekabiliyet ilkesine dayalı olarak, mevcut veya elde edilebilir en geniş kapsamdaki bilgileri kendiliğinden ya da talep üzerine serbestçe paylaşacaklardır. 3. MİB”ler, bu Mutabakat Muhtırasının yorumlanması ve uygulanmasının Egmont Grubu'nun düzenlemeleri, özellikle “Şartı” ve “Mali İstihbarat Birimleri Arasında Bilgi Paylaşım Prensipleri” ile tutarlı olmasını temin edeceklerdir. MİB”ler, bu Mutabakat Muhtırası kapsamında olmayan ilave hususlarda bu düzenlemeleri dikkate alacaklardır. 4. Bu Mutabakat Muhtırası, MİB'ler arasındaki işbirliğinin güçlendirilmesi ve geliştirilmesi amacıyla imzalanmış olup, MİB/lerin Devletlerini uluslararası hukukta bağlayan uluslararası bir anlaşma değildir. Bu Mutabakat Muhtırasının hiçbir hükmü, MİB'lerin Devletleri için yasal haklar veya taahhütler meydana getirecek şekilde yorumlanamaz ve uygulanamaz. Talepte Bulunma 5. Taleplerin zamanında ve etkin bir şekilde yerine getirilebilmesi için MİB 'ler taleplerinde analizi yapılan olayın açıklaması ve talepte bulunulan Ülke ile potansiyel bağlantısı gibi bilgiler de dahil olmak üzere, gerçeklere dayalı bağlantılı bilgiler ile hukuki bilgilerin verilmesi için en üst seviyede gayret sarf edeceklerdir. Ayrıca herhangi bir ivedilik ihtiyacını da belirteceklerdir. 6. MİBler taleplerin gerekçelerini, talebin kimin adına gönderildiğini (eğer varsa) ve mümkün olduğu ölçüde de talep edilen bilgilerin kullanılma amacını belirteceklerdir. 7. Talepte bulunulan MİB talepte yer alan bilgileri, talepte bulunan MİB”in önceden yazılı izni olmaksızın talepte yer almayan kişilere veya talepte belirtilmeyen amaçlarla açıklamayacaktır. Talepte aksi belirtilmedikçe, talepte bulunulan MİB'in kendi ülkesindeki diğer uygun kamu kurumlarına, talebe cevap niteliğindeki bilgileri elde etmek için, gerçek ve tüzel kişilere ilişkin bilgiler de dahil olmak üzere talebin içeriğini iletmesine izin verilecektir, ancak talepte bulunulan MİB'in gizliliği temin edilecektir. Cevaplar 8. MİB”ler taleplerin alındığını bildirecek ve bu taleplere zamanında cevap vereceklerdir. MİB'ler talebe cevabın tam olarak verilmesinin gecikebileceği durumlarda geçici veya kısmi cevap vermek için azami gayreti göstereceklerdir. 9. MİB”ler, talepte bulunan muadilleri adına araştırmaları yapacak ve bu araştırmalar yurtiçinde yapılmışsa elde edebilecekleri bütün bilgileri vereceklerdir. MİB'ler özellikle ulusal mevzuat çerçevesine uygun olarak aşağıda belirtilen bilgileri vereceklerdir: a. Doğrudan veya dolaylı olarak erişim sağlanabilir veya elde edilebilir olması gereken bütün bilgiler; bunlar özellikle, MiB'lerin kendi yurtiçi analizleri için elde etme yetkisine sahip oldukları bilgileri kapsamaktadır; ve b. MİB/lerin yurtiçinde doğrudan veya dolaylı olarak elde etme veya erişim sağlama yetkisine sahip oldukları diğer her türlü bilgiler. Bilgilerin Kullanılması ve Açıklanması 10. MİB/ler paylaşılan bilgileri sadece talep edilme veya verilme amaçları için kullanacaklardır. Bilgilerin başka yetkili makamlara dağıtımı veya bu bilgilerin başlangıçta üzerinde anlaşılan amaçlar dışında kullanılması, talepte bulunulan taraftan önceden izin alınması şartına bağlı olacaktır. 11. Bilgilerin başka suretle kullanımı veya dağıtımı için gereken ön izin MİB'ler tarafından ivedilikle ve mümkün olan en geniş ölçüde verilecektir. Bu ön izin talebi bilgiyi veren MİB”in ülkesindeki karapara aklama ve terörizmin finansmanıyla mücadele düzenlemelerinin uygulama alanı dışında kalmadığı, bir ceza soruşturmasına halel getirmediği, bilgiyi veren MİB'in ülkesindeki gerçek veya tüzel kişilerin ya da söz konusu MİB”in Devletinin yasal menfaatleri ile açık bir şekilde orantısız olmadığı ya da bilgiyi veren MİB'in ulusal hukukunun temel ilkelerine uygun olduğu müddetçe reddedilmeyecektir. 12. Ön izin vermenin reddedilmesi uygun bir şekilde gerekçelendirilecek ve açıklanacaktır ve MİB»ler paylaşılan bilgilerin yetkili kolluk makamları ve savcılar tarafından kullanılabilmesini temin etmek amacıyla kullanılabilecek alternatif yolları (örneğin karşılıklı adli yardımlaşma kanalları gibi) araştıracaklardır. 13. Eğer bir MİB, diğer MİB'den aldığı bilgileri açıklamasını gerektirecek yasal bir süreç ya da işleme tabi olur ise, söz konusu sürece ya da işleme tabi olan MİB ivedi olarak diğer MİB'i bilgilendirecek ve bilginin daha fazla ifşa edilmesini sınırlandırmak için makul gayreti gösterecektir. Geri Bildirim 14. Talep üzerine ve mümkün olduğunda, MİB/ler verilen bilginin kullanımı ve bu bilgiye dayalı olarak (o gerçekleştirilen analiz sonuçları hakkında yabancı muadillerine geri bildirim sağlayacaklardır. Gizlilik 15. Mevcut Mutabakat Muhtırasının uygulanmasıyla elde edilen bilgiler gizlidir. Bilgiler resmi gizliliğe tabidir ve asgari olarak bilgiyi alan MİB'in ulusal kaynaklarından elde ettiği benzer bilgiler için ulusal mevzuatının öngördüğü aynı gizlilik içerisinde korunacaktır. Bilgi Talebinin Reddi 16. MİB”lerin özellikle aşağıdaki durumlarda yardımlaşma yükümlülüğü bulunmamaktadır: a. Talebe ilişkin olaylar hakkında hâlihazırda başlatılmış adli yargılamanın bulunması, b. Yardımlaşmanın talepte bulunulan MİB'in Ülkesinin ulusal yasal sistemine veya ulusal güvenliğine ya da uluslararası anlaşmalara aykırı olması. Talepte bulunan MİB, bilgi talebinin reddine ilişkin olarak bilgilendirilecektir. 17. MİB/ler, yardım sağlanmasını aşağıdaki gerekçeleri ileri sürerek reddetmeyecektir: a. Talebin vergilemeye ait konuları da ihtiva ettiğinin değerlendirilmesi, b. Yasaların finansal kurumları veya finansal olmayan belirli iş ve meslekleri (talep edilen ilgili bilginin yasal bir imtiyazın veya yasal bir mesleki gizliliğin uygulandığı koşullarda tutulması haricinde) gizliliği veya güvenliği korumaya yükümlü tutması, e. Yardımın soruşturma, inceleme ya da adli yargılamayı engellemediği sürece, talepte bulunulan MİB'in Ülkesinde talep edilen bilgiye ilişkin devam eden bir soruşturma, inceleme ya da adli takibatın bulunması, d. Talepte bulunan MİB:'in niteliği ya da statüsünün (mülki, idari, kolluk makamı vs.) muadilinden farklı olması, e. Talepte belirtilen olayın konuyla bağlantılı veya şüpheli olarak değerlendirilmemesi ya da analiz aşamasında öncül suçun bilinmemesi. İletişim ve Prosedürler 18. Bilgi paylaşımları güvenli bir şekilde ve güvenilir kanallar ya da mekanizmalar vasıtasıyla yapılacaktır. Bu amaçla MİBler Egmont Güvenli Ağı'nı veya asgari olarak Egmont Güvenli Ağı'nın sağladığına eşdeğer güvenlik, güvenilirlik ve etkililik seviyesi sağlayan ve MİB'ler tarafından kabul edilen diğer yolları kullanacaklardır. 19. MİB'ler, bu Mutabakat Muhtırasının uygulanması amacı ile her bir Ülkenin mevzuatına uyumlu olarak kabul edilebilir iletişim prosedürleri için müşterek düzenleme yapacaklar ve birbirleri ile istişarede bulunacaklardır. 20. MİB”ler arasındaki iletişim, mümkün olduğunca İngilizce dilinde gerçekleştirilecektir. 21. Mümkün olduğu ölçüde, tüm bilgi talepleri, bilgi taleplerine ilişkin cevaplar, bilgi paylaşımları, bildirimler ve bu Mutabakat Muhtırasına uygun olarak verilen izinler yazılı olarak yapılacaktır. İşbirliğinin Geliştirilmesi 22. MİB/ler, karapara aklama ve terörizmin finansmanının önlenmesi, tespiti ve caydırılmasına ilişkin olarak aralarında işbirliği yapabilecekleri diğer alanları müzakere edeceklerdir. Değişiklikler 23. Bu Mutabakat Muhtırası MİB*lerin karşılıklı yazılı rızası ile her zaman değiştirilebilir. Bu değişiklikler 25. maddede belirtilen usulle yürürlüğe girecektir. Fesih 24. MİB”lerden her biri bu Mutabakat Muhtırasını diğerine yazılı bildirimde bulunarak her zaman feshedebilir. Bu durumda Mutabakat Muhtırası bu yöndeki yazılı bildirimin alındığı gün fesholacaktır. Bu Mutabakatın feshi, 10, 13 ve 15. maddelerin hükümlerine halel getirmeksizin gerçekleşecektir. Yürürlüğe Giriş 25. Bu Mutabakat Muhtırası belirli bir süre ile sınırlı olmaksızın imzalanmıştır. MİB'ler bu Mutabakata ilişkin onaylarını birbirlerine yazılı bildirim yoluyla iletecek ve Mutabakat Muhtırası son bildirim tarihinde yürürlüğe girecektir. Bu Mutabakat Muhtırası Ankara'da 03.11.2025 tarihinde ve Vatikan Şehir Devleti'nde 27.11.2025 tarihinde İngilizce dilinde ve eşit şekilde geçerli kabul edilen iki orijinal nüsha halinde imzalanmıştır. Başkan Yardımcısı Görevini Yürüten Yönetici MEMORANDUM OF UNDERSTANDING BETWEEN THE MINISTRY OF TREASURY AND FINANCE, FINANCIAL CRIMES INVESTIGATION BOARD (MASAK) OF THE REPUBLIC OF TÜRKİYE AND THE SUPERVISORY AND FINANCIAL INFORMATION AUTHORITY OF THE HOLY SEE / VATICAN CITY STATE CONCERNING COOPERATION IN THE EXCHANGE OF FINANCIAL INTELLİGENCE RELATED TO MONEY LAUNDERING, ASSOCIATED PREDICATE OFFENCES AND TERRORISM FINANCING The Ministry of Treasury and Finance, Financial Crimes Investigation Board (MASAK) of the Republic of Türkiye and the Supervisory and Financial Information Authority of the Holy See / Vatican City State (ASIF) hereafter referred to as "the Financial Intelligence Units (FIUs)", desire, in a spirit of cooperation and mutual interest, to facilitate the analysis concering cases of suspected money laundering, associated predicate offences and terrorism financing, with a view to disseminating information which may ultimately result in investigations and prosecutions by competent authorities in their respective Jurisdictions. To that end, having regard to the relevant documents of the Egmont Group, particulariy, the “Charter” and the “Principles for Information Exchange between Financial Intelligence Units” and within the framework of each FIU's domestic legislation, the FIUs have reached the following understanding. Objective 1. The FIUs will cooperate in accordance with the national legislation of their respective Jurisdictions to assemble, develop and analyse information relevant to suspected money İaundering, associated predicate offences and terrorism financing. 2. The FIUs will freely exchange spontaneously or upon reguest the widest range of information available or obtainable to the extent permitted by legal regulations, based on reciprocity. 3. In interpreting and implementing this Memorandum the FIUs will ensure consistency with the provisions of the Egmont Group, particularly with the “Charter” and the “Principles for Information Exchange between Financial Intelligence Units”. FIUs will consider these provisions for any further issue which is not covered in this Memorandum. 4. This Memorandum is concluded with a view to enhancing and developing coopcration between the FIUs and does not constitute an international agreement binding upon the Jurisdictions of the FIUs under intemational law. No provision of this Memorandum will be interpreted and implemented as creating legal rights or commitments for the Jurisdictions of the FIUS. Making regüests 5. To enable a timely and efficient execution of the reguests, the FİUs will make their best etforts to provide, in the reguests, relevant factual and legal information, including the description of the case being analysed and the potential link with the Jurisdiction of the reguested counterpart. They will also indicate any need for urgency. 6. The FIUs will indicate the reasons for the reguests, the parties (if any) on behalf of whom those are sent and, to the extent possible, the purpose for which the information will be used. 7. The reguested FIU shall not disclose the information contained in the reguest for information to parties or for purposes not identified in the reguest without the prior written consent of the reguesting, FIU. If not otherwise stated in a reguest, the reguested FİU will be allowed to transmit to other appropriate agencies of the government of the reguested FIU the content of the reguest, including details of individuals and entities, to obtain information responsive to the reguest, while ensuring the confidentiality of the reguesting FIU. Responses 8. The FUs will acknowledge receipt of the reguests and will respond to such reguests in a timely manner. FİUs will further use their best efforts to provide interim or partial responses in a timely manner in such cases where there may be a delay in providing a full response. 9. The FIUs will conduct gueries on behalf of the reguesting counterpart and provide all information that they would be able to obtain if such gueries were carried out domesticaliy. In particular, FİUs will provide, consistently with the domestic legislati ve framework: a. all information reguired to be accessible or obtainable directly or indirectly; this includes in particular the information that FIUs have the power to obtain for their domestic analysis; and b. any other information which they have the power to obtain or access, directly or indirectiy, at the domestic level. Use and Disclosure of Information 10. The FlUs will use the information exchanged only for the purpose for which it was sought or provided. Any dissemination of the information to other authorities of governments or any use of this information beyond those originally approved will be subjcct to prior authorizatton by the reguested counterpart. 11. The prior consent for further use or dissemination will be granted by the FIUs promptiy and to the largest extent possible. Such consent will not be refused unless this would fall beyond the scope of application of the providing FIU's AML/CFT provisions, could impair a criminal investigation, would be clearly disproportionate to the legitimate interests of a natural or legal person or the Jurisdiction of the providing FIU or would otherwise not be in accordance with fundamental principles of its national law. 12. Any refusal to provide the prior consent Will be appropriately motivated and explained and the FIUs will explore alternative ways (e.g. through mutual legal assistance channels) to ensure that the information exchanged can be used by competent law enforcement agencies and prosecutors. 13. Ifa FIU is subject to legal process or proceedings that could reguire the disclosure of information it has received from the other FİU, the FİU subject to such process or proceedings will immediately notify the other FU and make reasonable efforts to limit further disclosure of the information. Feedback 14. Upon reguest and whenever possible, FIUs will provide feedback to their foreign counterparts on the use of the information provided, as wel| as on the outcome of the analysis conducted, based on the information provided. Confidentialitp 15. The information acguired in application of the present Memorandum is confidential. It is subject to official secrecy and is protected by at least the same confidentiality as provided by the national legislation of the receiving FIU for similar information from national sources. Refusals 16. The FIUs will be under no obligation to give assistance, especialIy if: a. the judicial proceedings conceming the same facts as those related to the reguest have already been initiated; b. the assistance would be contrary to the domestic legal system or to national security of the Jurisdiction of the reguested FIU or international agreements, The reguesting FIU will be informed of the reason for refusal, 17. The FIUs will not refuse to provide assistance on the grounds that: a, fhe reguest is also considered to involve fiscal matters; b. laws reguire financial institutions or designated non-financial businesses and professions (except where the relevant information that is sought is held under circumstances where legal privilege or legal professional secrecy applies) to maintain secrecy or confidentiality; c. there is an inguiry, investigation or proceeding underway in the Jurisdiction of the FIU receiving the reguest, unless the assistance would impede (hat inguiry, investigation or proceeding; d. the nature or status (civil, administrative, law enforcement etc.) of the reguesting FIU is different to its counterpart, e. the case to which the reguest refers to is not considered relevant or suspicious or the specific type of the predicate offence is not known in the analytical phase. Communication and Procedures 18. Exchanges of information will take place in a secure way and through reliable channels or mechanisms. To this end, the FIUs will use the Egmont Secure Web or other Ways accepted by the FIUs that ensure levels of security, reliability and effectiveness at least eguivalent to those of the Egmont Secure Web. 19. The FIUs will jointiy arrange, consistent with-the İegislation of their respective Jurisdictions, for acceptable procedures of communication and will consult each other with the purpose of implementing this Memorandum. 20. Communication between the FIUs will as far as possible take place in English. 21. To the extent possible, all reguests for information, responses to reguests for information, exchange of information, notices, and consents provided pursuant to this Memorandum wili be in written, Further Cooperation 22. The FIUs will discuss other avenues of cooperation between them in the prevention, detection and deterrence of money laundering and terrorist financing. Amendmenis 23. This Memorandum may be amended by mutual written consent of the FİUs at any time. The amendments will come into effect with the same procedure prescribed under Paragraph 25. Termination 24. Each of the FIUs can terminate this Memorandum of Ünderstanding at any time by notifying the other in writing. In this case, this Memorandum of Understanding will be terminated on the day of the receipt of the written notification to that effect, Any termination of this Memorandum shall be without prejudice to the provisions of Articles 10, 13 and 15. Entry into Effect 25. This Memorandum of Understanding is concluded for an indefinite period of time. The FlUs will communicate their approval of this Memorandum by exchange of written notification and it will entry into effect on the date of the last notification.
