İŞBİRLİĞİNE DAİR MUTABAKAT MUHTIRASI

Türkiye Cumhuriyeti Hazine ve Maliye Bakanlığı Mali Suçları Araştırma Kurulu Başkanlığı (MASAK) ile Çin Halk Cumhuriyeti Hong Kong Özel İdare Bölgesi Ortak Mali İstihbarat Birimi (JFIU), (bundan böyle “Yetkili Makam” veya birlikte “Yetkili Makamlar” olarak anılacaklardır), İşbirliği ve karşılıklı menfaat anlayışı içinde, ülkelerindeki yetkili makamlar tarafından soruşturma ve kovuşturma başlatılması ile sonuçlanabilecek bilgi paylaşımı amacıyla şüpheli karapara aklama, bağlantılı öncül suçlar ve terörizmin finansmanı ile ilgili analizlerin kolaylaştırılmasını isteyerek; İlgili Egmont Grubu belgelerini, özellikle “Şartı”nı ve “Mali İstihbarat Birimleri Arasında Bilgi Paylaşım Prensipleri”ni göz önünde bulundurarak; Her birinin ülkesinde geçerli olan kanunlar ve düzenlemeler çerçevesinde; Aşağıdaki şekilde anlaşmaya varmışlardır. Amaç 1. Yetkili Makamlar, şüphelenilen karapara aklama, bağlantılı öncül suçlar ve terörizmin finansmanına ilişkin bilgilerin toplanması, geliştirilmesi ve analizinde işbirliği yapacaklardır. 2. Yetkili Makamlar, mütekabiliyet ilkesine dayalı olarak, mevcut ve elde edilebilir en geniş kapsamdaki bilgileri kendiliğinden ya da talep üzerine serbestçe paylaşacaklardır. 3. Bu Mutabakat Muhtırası'nın yorumlanmasında ve uygulanmasında, Yetkili Makamlar Egmont Grubu belgelerine, özellikle “Şartı”na ve “Mali İstihbarat Birimleri Arasında Bilgi Paylaşım Prensipleri”ne başvurabilirler. Yetkili Makamlar, bu Mutabakat Muhtırası'nın kapsamı dışında kalan hususlarla ilgili olarak Egmont Grubu belgelerine başvurabilirler. 4. Bu Mutabakat Muhtırası”nın amacı Yetkili Makamlar arasındaki işbirliğinin arttırılması ve geliştirilmesidir. Bu Mutabakat Muhtırası Yetkili Makamlar'ın uzlaşmasını temsil etmekte olup, Yetkili Makamlar için yasal olarak bağlayıcı hiçbir yükümlülük ya da karşılıklı hak doğurması amaçlanmamaktadır. 5. Bu Mutabakat Muhtırası'nın işleyişi ülkelerin kendi ulusal kanun ve düzenlemelerine tabidir. Talepte Bulunma 6. Taleplerin zamanında ve etkin bir şekilde yerine getirilebilmesi için Yetkili Makamlar, bilgi talebinde analiz edilen olaya ilişkin açıklama, olayın talepte bulunulan ülke ile olan muhtemel bağlantısı ve taleple ilgili herhangi bir aciliyetin olup olmadığına dair bilgi de dahil gerçeklere dayalı bağlantılı bilgiler ile hukuki bilgileri vermek için azami gayreti gösterecektir. 7. Yetkili Makamlar talebin nedenlerini, (varsa) talebin hangi kurum adına gönderildiğini ve mümkün olduğu ölçüde talebe istinaden edinilecek bilgilerin ne amaçla kullanılacağını belirteceklerdir. 8. Talepte bulunulan Yetkili Makam talep içeriğinde yer alan bilgileri, talebin yerine getirilmesi için gerekli olması ya da talepte bulunan Yetkili Makamın önceden yazılı izin vermesi halleri dışında üçüncü taraflara ya da talepte belirtilen amaçlar dışında açıklamayacaktır. Cevaplar 9. Talepte bulunulan Yetkili Makam talebi aldığını bildirecek ve talebe zamanında cevap verecektir. Talebe cevabın tam olarak verilmesinin gecikebileceği durumlarda, talepte bulunulan Yetkili Makamı talebe geçici veya kısmi cevabı zamanında vermek için azami gayreti gösterecektir. 10. Talepte bulunulan Yetkili Makam, mütekabiliyete dayalı olarak, talepte bulunan Yetkili Makam adına araştırmalar yapacak ve bu araştırmalar yurt içinde yapılmışsa, elde edebileceği bütün bilgileri verecektir. Bilhassa, Yetkili Makamlar yurt içi analizler için doğrudan veya dolaylı olarak elde etme veya erişme yetkilerinin olduğu tüm bilgileri sağlayacaktır. Bilgilerin Kullanılması ve Açıklanması 11. Bu Mutabakat Muhtırası kapsamında yapılan bir talebe istinaden sağlanan bilgilerin kullanılması aşağıdaki sınırlamalara tabidir:

(a) Talepte bulunan Yetkili Makam bilgileri bu Mutabakat Muhtırası'nda belirtilen veya talepte bulunulan Yetkili Makam tarafından kabul edildiği şekilde talepte belirtilen amaçlar dışında kullanmayacaktır;

(b) Talepte bulunan Yetkili Makam, talepte bulunulan Yetkili Makamdan alınan bilgileri, önceden kendisinden yazılı izin alınmadıkça, talepte belirtilmeyen herhangi bir tarafla paylaşmayacaktır.

(c) Talepte bulunan Yetkili Makam, talepte bulunulan Yetkili Makamdan alınan bilgileri idari, kovuşturma veya adli yargılama işlemleri dahil olmak üzere herhangi bir işlemde delil olarak kullanmayacaktır. Bu tür bilgiler yalnızca istihbarat amacıyla kullanılacaktır. 12. Talepte bulunan Yetkili Makam bilgilerin talepte bulunulan Yetkili Makamdan önceden yazılı izin alınmadıkça başka herhangi bir tarafa açıklanamayacağını ve bilgilerin herhangi bir işlemde delil olarak kullanılamayacağını kolluk makamlarına bildirmek için bilgi talebinde belirtilen kolluk makamlarına sağlanan her türlü bilgiye uyarı notları ekleyecektir. 13. Talepte bulunan Yetkili Makam, diğer Yetkili Makamdan aldığı bilgileri kanun gereği açıklamakla yükümlü ise, diğer Yetkili Makamı derhal haberdar edecek ve bilgileri açıklamak için yazılı iznini isteyecektir. Yazılı iznin verilmemesi durumunda talepte bulunan Yetkili Makam bilgilerin herhangi bir üçüncü tarafa açıklanmamasını veya açıklamaya uygun sınırlamalar getirilmesini sağlamak için makul gayret gösterecektir. Yazılı izin talepte bulunulan Yetkili Makam tarafından makul olmayan nedenlerle reddedilmeyecektir. Geribildirim 14. Talep üzerine ve mümkün olduğunda, bir Yetkili Makam verilen bilgilerin kullanımı ve bu bilgilere dayalı olarak gerçekleştirilen analizin sonuçları hakkında diğer Yetkili Makama geribildirim sağlayacaktır. Gizlilik 15. Bu Mutabakat Muhtırası kapsamında edinilen bilgiler gizlidir. Bu bilgiler, bilgiyi alan Yetkili Makamın ulusal kanun ve düzenlemelerinde resmi sırlara ve gizli bilgilere uygulananlara benzer korumaya tabi olacaktır. Talebin Reddi 16. Talepte bulunulan Yetkili Makam, talep edilen bilgilerin verilmesinin kendi ülkesindeki bir soruşturma veya adli işlemi olumsuz etkileyebileceğine ya da kendi ulusal kanun ve düzenlemeleri gereğince bu bilgilerin verilmesinin yasaklanmış olduğuna karar verirse talepte bulunan Yetkili Makama bilgi vermeyi reddedebilir. 17. Talepte bulunulan Yetkili Makam aşağıdaki durumlarda bilgi vermeyebilecektir:

(a) Bilgi talebinde iddia olunan aynı eylemlere veya ihmal durumlarına ilişkin olarak bilgi talebinde bulunulan Yetkili Makamın ülkesinde halihazırda başlatılmış adli yargılamanın bulunması

(b) Bu tür bilgilerin verilmesinin Çin Halk Cumhuriyeti'nin egemenliğine veya Çin Halk Cumhuriyeti veya onun herhangi bir parçasının güvenliğine veya kamu düzenine veya Çin Halk Cumhuriyeti Hong Kong Özel İdare Bölgesi'nin asli çıkarlarına zarar verme ihtimalinin olması veya, (©) Bu tür bilgilerin verilmesinin Türkiye Cumhuriyeti'nin egemenliğine, güvenliğine, kamu düzenine veya asli çıkarlarına zarar verme ihtimalinin olması. 18. Talepte bulunulan Yetkili Makamın bir talebe cevap vermeme kararı alması durumunda bu durum talep bulunan Yetkili Makama gerekçeleriyle birlikte bildirilecektir. 19. Yetkili Makamlar yardımda bulunmayı aşağıdaki gerekçelerle reddetmeyeceklerdir:

(a) Talep vergileme konularıyla ilgili olması;

(b) Talep bankacılık sırrı ile ilgili olması; veya

(c) Talepte bulunan Yetkili Makamın mahiyeti veya statüsü ile ilgili olması. İletişim ve Prosedürler 20. Bilgi paylaşımları güvenli bir şekilde ve güvenilir kanallar ya da mekanizmalar vasıtasıyla yapılacaktır. Bu amaçla Yetkili Makamlar Egmont Güvenli Ağı'nı veya asgari olarak Egmont Güvenli Ağı'nın sağladığına eşdeğer güvenlik, güvenilirlik ve etkililik seviyesi sağlayan ve Yetkili Makamlar tarafından kabul edilen diğer yolları kullanacaklardır. 21. Yetkili Makamlar, bu Mutabakat Muhtırası'nın uygulanması amacı ile her bir ülkenin mevzuatına uyumlu olarak kabul edilebilir iletişim prosedürleri için müşterek düzenleme yapacaklar ve birbirleri ile istişarede bulunacaklardır. 22. Yetkili Makamlar arasındaki iletişim, mümkün olduğunca İngilizce dilinde gerçekleştirilecektir. 23. Mümkün olduğu ölçüde, tüm bilgi talepleri, bilgi taleplerine verilen cevaplar, bilgi paylaşımları, bildirimler ve bu Mutabakat Muhtırası uyarınca verilen izinler yazılı olacaktır. İşbirliğinin Geliştirilmesi 24. Yetkili Makamlar, karapara aklama ve terörizmin finansmanının önlenmesi, tespiti ve caydırılmasına ilişkin olarak aralarında işbirliği yapabilecekleri diğer alanları müzakere edeceklerdir. Değişiklikler 25. Bu Mutabakat Muhtırası karşılıklı yazılı rıza ile her zaman değiştirilebilir. Yetkili Makamlar, bu değişikliklere dair onaylarını karşılıklı olarak yazılı şekilde bildireceklerdir. Değişiklikler son bildirim tarihinde yürürlüğe girecektir. Fesih 26. Bu Mutabakat Muhtırası, diğer Yetkili Makama yazılı olarak bildirilmek suretiyle, her zaman feshedilebilir. Fesih, diğer Yetkili Makamdan yazılı bildirimin alınmasından itibaren yürürlüğe girecektir. 27. Bu Mutabakat Muhtırasının feshi, bu fesihten önce ya da fesih tarihinde bu Muhtıradan kaynaklanan veya bu Muhtıraya bağlı olan hak ve yükümlülüklere halel getirmeyecektir Bu Mutabakat Muhtırası'nın feshinden önce alınan bilgilerin gizliliğini temin eden hükümler, Mutabakat Muhtırası'nın fesih olmasından sonra da yürürlükte kalacaktır. Yürürlük Tarihi 28. Yetkili Makamların her biri bu Mutabakat Muhtırası'nın onaylandığını yazılı olarak diğer Yetkili Makama bildireceklerdir. Bu Mutabakat Muhtırası son bildirim tarihinde yürürlüğe girecektir. Bu Mutabakat Muhtırası Hong Kong ve Türkiye'de aşağıda belirtilen tarihte İngilizce dilinde iki suret olarak imzalanmıştır. Have reached the following understanding. Objective

I. The Authorities will cooperate to assemble, develop and analyse information related to suspected money laundering, associated predicate offences and terrorism financing. 2. The Authorities will, based on reciprocity, İreely, spontaneously or upon reguest exchange the widest range of information available or obtainable. 3. In interpreting and implementing this Memorandum, the Authorities may make reference to the documents of the Egmont Group, particularly the “Charter” and the “Principles for Information Exchange between Financial Intelligence Units”. The Authorities may refer to the documents of the Egmont Group in considering issues which are not covered in this Memorandum. 4, This Memorandum is intended to enhance and develop cooperation between the Authorities. This Memorandum represents the understanding of the Authoritjes and is not intended to create any İegally binding obligations or corresponding rights for the Authorities. 5. The operation of this Memorandum is subject to the laws and regulations of their respective Jurisdictions. Making Reguesi 6. To enable a timely and efficient execution of the reguest, the Authorities will make their best efforts to provide in the reguest relevant factual and legal information, including the description of the case being analysed, the potential link with the reguested jurisdiction and any need for urgeney. 7.The Authorities will provide the reasons for the reguest, the parties (if any) on behalf of whom the reguesi is sent and, to the extent possible, the purpose of use of the information obtained pursuant to the reguest. 8. The reguested Authority will not disclose the information contained in the reguesi to third parties or for purposes not identified in the reguest, excepi to ihe extent necessary for executing the reguest or with the prior written consent of the reguesting Authority. Responses 9. The reguested Authority will acknowledge receipt of the reguest and will respond to such reguest in a timely manner. If delay in providing a full response is anticipated, the reguested Authority will use its best efforts to provide interim or partial response in a tmely manner. 10. The reguested Authority will, on the basis of reciprocity, conduct gueries on behalf of the reguesting Authority and provide all information that they Would be able to obtain if such gueries were carried out domesticaliy. In particular, the Authorities will provide all information that the Authorities have the power to obtain or access, directly or indirectly, for their domestic analysis. Use and Disclosure of Information 11. Use of any information supplied pursuant to a reguest made under this Memorandum is subject to the following limitations:

(a) the reguesting Authority will not use the information for purposes other than ihose stated in this Memorandum or set forth in the reguest as accepted by the reguested Authority;

(b) the reguesting Authority will not share the information received from the reguested Authority with any party not identified in the reguest, ünless the prior written consent of the reguested Authority is obtained. Any refusal to provide prior written consent will be explained and the Authorities will consult each other to explore alternative ways; and

(c) the reguesting Authority will not use the information received from the reguested Authority as evidence in any proceedings, including administrative, prosecutorlal or judicial proceedings. Such information is to be used for intelligence purposes only. 12. The reguesting Authority will include warning notices on any information that it provides to ihe law enforcement agencies identified in the reguest for information, in order to place the law enforcement agencies on notice that the information cannot be disclosed to any other party unless the prior written consent of the reguested Authority is obtained, and that the information cannot be used as evidence in any proceedings. 13. If the reguesting Authority is reguired by law to disclose information it has received from the other Authority, the reguesting Authority will immediately notify and seek the written consent of the other Authority to disclose the information. If written consent has not been provided, the reguesting Authority will make reasonable efforts to ensure that the information will not be disclosed to any third party or that appropriate limitations are placed upon the disclosure. Written consent will not be unreasonabiy withheld by the reguested Authority. Feedback 14. Upon reguest and whenever possible, an Authority will provide feedback to the other Authority on the use of the information provided, as well as on the outcome of the analysis conducted, based on the information provided. Confidentiality 15. The information acguired under this Memorandum is confidential. It will be subject to similar protection as applicable to official secrets and confidential information as provided by the domestic laws and regulations of the receiving Authority. Refusals 16. The reguested Authority may refuse to provide information to the reguesting Authority ifthe reguested Authority determines that release of the information reguested may adversely affect an investigation or proceeding in its jurisdiction or is otherwise prohibited by its domestic laws and regulations. 17. The reguested Authority may not provide information -

(a) if judicial proceedings have been initiated in the jurisdiction of the reguested Authority in relation to the same acts or omissions alleged in the reguest for information;

(b) if provision of such information would be likely to impair the sovereignty of the People's Republic of China, or the security or public order of the People's Republic of China or any part thereof, or essential interests of the Hong Kong Special Administrative Region of the People's Republic of China; or

(c) if provision of such information would be likely to impair the sovereigniy, security, public order or essential interests of the Republic of Turkey. 18. If the reguested Authority decides not to respond to a reguest, it will notify the reguesting Authority of its decisions with reasons. 19. The Awihorities will not refuse to provide assistance on the following grounds:

(a) the reguest is related to fiscal matlers;

(b) bank secrecy; or

(6) the nature or status of the reguesting Authority.

Communication and Procedures

20. Exchanges of information will take place in a secure way and through reliable channels or mechanisms, For this purpose, the Authorities will use the Egmont Secure Web or other ways accepted by the Authorities that ensure eguivalent levels of security, reliability and effectiveness. 21. The Authorities will jointly arrange, consistent with the laws and regulations of their respective jurisdictions, for acceptable procedures of communication and will consult each other with the purpose of implementing this Memorandum. 22. Communication between the Authorities will as far as possible take place in English. 23. To the extent possible, all reguests for information, responses to reguests for information, exchange of information, notices and consents provided pursuant to this Memorandum will be in writing. Further Cooperation 24. The Authorities will discuss other ways of cooperation between themselves in the prevention, detection and deterrence of money laundering and terrorism financing. Amendmenis 25. This Memorandum may be amended at any time by mutual consent. The Authorities will communicate their consent to the amendments by exchange of written notification. Amendmenis will take effect on the date of the last notification. Termination 26. This Memotandum may be terminated at any time by giving written notification to the other Authority. The termination will become effective as from the receipt of the written notification from the other Authority. 27. The termination of this Memorandum will not adversely affect the rights and commitmenis arising from or based on this Memorandum before or up to the date of such termination. The provisions relating to confidentiality of the information received prior to the termination of this Memorandum will continue to have effect after the termination of this Memorandum. Effective Day 28. Each Authority will notify the other Authority in writing of their approval of this Memorandum., This Memorandum will become effective on the date of the later of the two notifications.
